Terms & Conditions

This document describes the terms and conditions of use of Safarimaris.eu which belongs to Gannet d.o.o. (“Safari Maris”, “we”, “us” or “our”). Gannet d.o.o. arranges all mentioned at Safarimaris.eu services. The following terms and conditions are the basis of the contract between you and Gannet d.o.o.

 

Booking Conditions
It is important that you read the following booking conditions carefully as they set out our respective rights and obligations. By paying you completely accepts these Booking Conditions. In these booking conditions, Gannet means travel agency Gannet d.o.o. and you means all persons named on the reservation. Safari Maris is a trading names which are related to Gannet d.o.o. Gannet d.o.o. is tour operator company, registered in the Republic of Slovenia since 2015 (address: : Planina 3, 4000 Kranj, Slovenia; No. 6616526000, VAT No. SI38680939). Our license is issued by Chamber of Commerce and Industry of Slovenia as official license for travel agency and tour operating.
A contract between us will only come into effect when we send you email booking confirmation document after we receive first deposit or full payment in accordance with Payment Schedule as it will be shown in your proforma invoice. When the contract comes into effect, we become responsible to provide you with the holiday you have booked, and you become responsible to pay for it, in each case subject to these terms and conditions.

 

In parties of two or more people, the person who actually makes the booking is the person whom we make the contract with and that person accepts responsibility for making all payments to us for all members of the party. Conversely, we will send all documents and other information to that person alone, who will be responsible for ensuring that all other members of the party are kept fully informed.

 

Description of services
The liveaboard facilities and travel services offered to you by Gannet via email or in any other way, and specified in proforma invoice are also described and illustrated online at our website. Gannet shall not be responsible for any verbal or written information obtained from a third party differing from the description of facilities and services in our offers and on our website.

 

At the time of booking, we also require the following information from all party members:
- Title & Full Name (as it appears on your passport)
- Passport Number & Nationality
- Date of Birth
- Address, telephone, email
- Current Diving Qualification
- Approx. no. of logged dives
- Insurance Policy Number, Provider and Contact Telephone No.
- Emergency Contact Details

 

Please ensure you have enough validity left on your passport in accordance with the requirements for your holiday destination.

 

GDPR
Gannet d.o.o. is committed to protecting and safeguarding your personal information because of your privacy is very important to us. Please read our Privacy Policy to find out how we handle your personal information minimized and limited to the purposes that you use our services for. Gannet d.o.o. only collects, uses, and discloses personal information in accordance with its Privacy Policy.

 

All our clients have the right to access, edit or delete their personal information along with the right to object to some processing of information. If you like to get, limit processing or delete your personal information you can do that by contacting us at [email protected] and we will respond within 24-48 hours. Please note that some personal information can’t be deleted immediately if any of your confirmed Reservations is still in progress.

 

For all our customers who are residents of the European Union we are the controller of personal information for the purposes of GDPR law.

 

Financial protection
In compliance with Directive (EU) 2015/2302 while purchasing a package through Gannet d.o.o. you are fully protected against the organizer’s insolvency or liquidity problems (Letter of Guarantee No. 1-543-0970118/19 issued by insurance company Zavarovalnica Sava d. d.).

 

Diving Medical Form
For daily diving or liveaboard trip, all divers are required to complete a self assessment medical form before diving. This form will be available onboard or in dive center upon arrival. Should you like to get this form in advance please require and we will provide it.

 

If you wish to change or cancel your booking, you may have to pay an amendment or cancellation charge and additional costs (see above) which may be as much as the whole of the original price of your arrangements.

 

Please note that travel arrangements may be subject to change. Change of accommodation to another of the same standard or higher within the same resort area or liveaboard is deemed to be a minor change. Minor change is not subject to refund.

 

If we make a major change to your holiday, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements from us if available or cancelling your booked holiday and receiving a full refund of all monies paid except where the major change arises due to reasons of force majeure. Major changes may include change of your accommodation to that of a lower rating/classification or change of your holiday to a different area.

 

Refund does not apply to circumstances beyond our control (force majeure). We or our partners can cancel your holiday in the following circumstances: war, threat of war, riots, civil strife or terrorist activity, industrial disputes, natural or nuclear disasters, fire, technical problems with transport, airport closures, bad weather conditions and similar events beyond our control.

 

Diving and Weather Conditions
Unfortunately weather patterns are hard to predict. In light of this you will have to accept that on some occasions at the discretion of the Dive guide or Instructor it may not be suitable or safe to conduct diving activities at your chosen diving location. On liveaboard boats an alternative itinerary may be necessary if weather conditions prove too difficult for diving. We cannot be held responsible or liable for weather patterns and the resulting loss of diving days, courses or activities. You may of course make a claim under the terms and conditions of your insurance policy.

 

Insurance
It is your responsibility to ensure that you have adequate insurance cover for your arrangements and activities and we can accept no responsibility if you fail to take out appropriate insurance in relation to these holiday arrangements. You must provide us with details of your insurance cover (insurers and policy numbers) in case we or our partners need to contact them on your behalf.

 

Diving Insurance
We recommend that at a minimum you get insurance that covers you for SCUBA diving to 40m. However, it is your responsibility to make sure that you have adequate insurance to cover all aspects of your holiday and it is your responsibility to make the appropriate arrangements. IMPORTANT: Diving insurance is mandatory on all liveaboards vessels and we strongly recommend trip insurance to cover any eventuality beyond your, or our, control.

 

Applicable law and jurisdiction
Gannet services are governed exclusively by the substantive laws of the Republic of Slovenia to the exclusion of conflict of law legislation as well as international law. The courts of Ljubljana, Slovenia, shall have exclusive jurisdiction for all disputes. To the extent permitted by law, the courts of Ljubljana shall be competent.
